Definitions
“Customer” or “you” means the person or company who places an order via this website to purchase any of the products.
“Products” means the products offered by Kingfisher Angling Centre Ltd via the website.
“Kingfisher” means Kingfisher Angling Centre Ltd.
“Website” means the website of Kingfisher Angling Centre Ltd.
These terms and conditions are applicable to the supply of Products by Kingfisher to the Customer. All other terms and conditions, express or implied by statute or otherwise are excluded to the fullest extent permitted by law.
Disclaimer
Kingfisher has the right to change prices and specifications without prior notice. Any colours shown are as accurate as the website allows. The availability of an item on the website does not guarantee that it is in stock. Any product related information (except where clearly stated as 'our opinion') has been supplied by a manufacturer or supplier and does not necessarily represent the opinion of Kingfisher.
Kingfisher reserves the right to refuse any order or part of order or to require further or better information to enable it to evaluate or process the order.
Kingfisher accepts no liability for any failure to ship products where this results from its inability to do so or its decision on reasonable grounds not to do so, provided it takes all reasonable steps to notify the customer within 14 days of order placement that products will not be shipped as ordered. In such cases Kingfisher will immediately refund any payments made in full. The consumer has the right to cancel their order within 7 working days which starts from the day after the day the customer receives the goods except where the goods are perishable. The customer will have to pay the cost of returning the goods. Kingfisher will refund the customers money within 30 days of cancellation.

Applicable Law
Kingfisher makes no representation that materials in the site, including merchandise offered for sale and their trademarks, patents, and licensing arrangements, are appropriate or available for use in locations other than the United Kingdom. Those who choose to access this site from locations outside of the U.K. do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. If any dispute arises out the use of this Web site you agree that these terms shall be governed by and interpreted in accordance with English law and be subject to the exclusive jurisdiction of the English courts.
Disputes
Any dispute relating in any way to your visit to a Kingfisher or to products you purchase through Kingfisher shall be submitted to confidential arbitration in the United Kingdom, except that, to the extent you have in any manner violated or threatened to violate Kingfisher intellectual property rights, Kingfisher may seek injunctive or other appropriate relief in any court in the United Kingdom, and you consent to exclusive jurisdiction and venue in such courts. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
Limitation of Liability
Kingfisher is not responsible or liable to any person or entity whatsoever for any direct or indirect loss, damage (whether actual, consequential, punitive, special, or otherwise), injury, claim, liability or other cause of any kind or character whatsoever based upon or resulting from any information or opinions provided on the site or from the use of, or the inability to use, the materials on the site. You specifically agree that Kingfisher is not liable for any defamatory, offensive, or illegal conduct of any user.
Pricing Policy
All products on Kingfisher website are priced in pounds sterling and include UK VAT at the prevailing rate. For orders being dispatched to countries outside the European Union we will deduct VAT from relevant items.
We may alter prices at any time. We try our best to keep price changes to a minimum but sometimes it is inevitable. We will aim to update the web site as soon as possible, but may not be able to make the changes immediately. If the price of an item you have ordered has increased we will contact you before charging the additional amount.
All prices are exclusive of carriage, postage and packing, unless otherwise stated.
Carriage or postage and packing (if applicable) are added to your order prior to purchase. You will be given the total price of the transaction including any VAT and carriage before you complete you purchase. There are no hidden extra costs. VAT is included in your order price. Orders delivered to and paid for from outside of EU (European Union) to non-UK businesses may be exempt from VAT.

Orders may be placed by phone, fax, mail or on line. We also run a 'bricks & mortar' shop and purchases can of course be made there. The address is:

Passing of Property
Kingfisher shall retain legal title to the products until all payment has been made in full by the Customer.
Passing of Risk
The risk on the Products shall pass to the Customer on delivery once the products have been signed for.
Payment Methods
Payments must be made in £ Sterling only, unless otherwise specified using any of the cards shown on our secure payments website pages. You can pay by all main credit or debit cards. For other methods of ordering we also accept cheques, cash, postal orders or our own gift vouchers. Cash is acceptable only if posted via a registered service such as Royal Mail Special Delivery in the UK.
After placing an order on the website the Customer will receive an e-mail confirmation of the order for purchase.
Card Security
We have chosen a proprietary shopping cart system and payment provider that keeps your credit/debit card information in a secure environment at all times.
During the on line checkout process the card holder's name and address must be provided in the 'Billing Information' and 'Credit/Debit Card Information' fields exactly as they are written on the statement. The same applies to the card holder's name and address supplied via any other order method.
Out of Stock Items
If any item you have ordered is not available straightaway for any reason we will automatically place the out of stock item on our back order system, which means that the day it is delivered to us it will be sent to you. If you would rather we deleted unavailable items from your order or substituted them, please indicate your preference when you order. The website checkout process provides the facility to do this.
Delivery Addresses
Please enter the delivery address in the appropriate fields if you are ordering on line or include it with your order if you use another order method.
Delivery
All delivery dates are given in good faith but are subject to all matters beyond the control of the Company: including acts of God, strikes, lockouts and delay by suppliers.
Any date or period for delivery shall be considered as indicative only although if a Product is in stock, we aim to send it out to you within 48 hours of your order. If we cannot dispatch an item to you within 21 days of order we will notify you by e-mail and at your request we will cancel the order and refund your money in full. Kingfisher cannot be held responsible for delays in the delivery caused by the manufacturer, or any other third party.
All deliveries are insured against loss.

Delivery Charges for On line Orders
Orders with total value up to £20 - delivery charge = £4.00
Orders with total value between £20 and £50 - delivery charge = £6.00
Orders with total value between £50 and £100 - delivery charge = £7.50
Orders with total value between £100 and £150 - delivery charge = £10.00
Orders with total value over £150 - delivery charge = FREE
Delivery to Outside the UK:
Orders with total value up to £20 - delivery charge = £10.00
Orders with total value between £20 and £50 - delivery charge = £15.00
Orders with total value between £50 and £100 - delivery charge = £20.00
Orders with total value between £100 and £150 - delivery charge = £25.00
Orders with total value over £150 - delivery charge = £35.00
Despatch
We operate from 9am on Monday to 5pm on Friday. We aim to despatch all orders by the end of the day (Monday to Friday) following receipt of the order. Orders received on a Friday, Saturday or Sunday will be despatched the following Monday as long as there are no problems. Standard despatch of orders to UK destinations is by first class post or via our carrier (24 hour service from time of despatch), depending on the goods ordered. Other services (next day (delivered Monday to Friday only) or Saturday morning delivery) are available on request for orders received before midday (UK time). Orders to non-UK destinations will be sent according to customer requirements.
Delivery Problems
Within the UK you can usually expect delivery of your order between 2 and 7 days from the day we receive it. If you have not received your order after 7 days please call us. Outside the UK please contact us if you have not received your order after 2 weeks.
Problems with Order Contents and Order Acceptance
The contents of your order should be checked immediately after delivery. Please telephone us straightaway if there are any problems.
Return of Goods Policy
We are happy to exchange unsuitable or unwanted items as long as they are returned to us in perfect condition, in the original packaging, with the relevant receipt or proof of purchase and within 28 days of delivery. In such circumstances we will not refund either the original postage or your return postage.
If goods are faulty, damaged in transit or have been sent to you in error we will refund the price paid in full and postage as long as the goods are returned in their original packaging, with the receipt and within 28 days of delivery.
If you wish to return goods please notify us beforehand.
We will not accept goods sent to us for refund or exchange that have not been originally purchased from us.
Goods bought on line, meeting the above criteria, may be returned in the shop if that is more convenient for you.
Refunds will be made by the same method used to pay for the item (e.g. if you paid by credit card any refund will be made to the same card).
Complaints
We always do our best to respond quickly and fairly to any problem relating to tackle purchased from us or the service provided. In the event of a problem, call us straightaway and we will do whatever is necessary to resolve it as fast as possible. In normal circumstances problems will be responded to within 24 hours, usually the same day we are notified.
Resale
Goods purchased from Kingfisher may not be used for resale.

Customer Information and Privacy Policy
We are committed to protecting your privacy. We are registered with the Data Protection Agency and comply fully with their requirements. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998).
We collect information about you for two reasons: firstly, to process your order and second, to provide you with the best possible service. The type of information we will collect about you includes: your name, address, phone number, fax number if relevant, email address and credit/debit card details. We will not give or sell your details to any other party for any reason unless you specifically ask us to do so.
The information we hold will be accurate and up to date. You can check the information that we hold about you by telephoning, writing or emailing us. If you find any inaccuracy we will delete or correct it promptly.
The personal information which we hold will be held securely in accordance with our internal security policy and the law.
Kingfisher will use only the methods supplied by you for communication with you (e.g. telephone, fax, mail address and/or email address). We will not contact you for any reason other than to process your order accurately or resolve any order related problems or service issues.
A Product Update and news facility is operated by email. You may un-subscribe at any time. We will only send email to you if you have purchased items from us in the past and we have not un-subscribed from the service.
